These general terms apply to and are valid and binding for every user who browses the website and its sections that are posted on the internet under the domain name “artgiannis.com”, as well as any other website that may be hosted under a subdomain of this domain.
Browsing the website and using the information and/or services it provides constitutes unconditional acceptance of these terms, which are at all times available for reading and review by all users in the footer of the website, via the relevant hyperlink titled “Terms of Use & Transactions”.
This website constitutes a space for the presentation, promotion and operation of the online store of the visual artist Ioannis Dendrinos, operating under the trade name “artgiannis.com”. It contains information about the business and its organisation, as well as the online store through which, in accordance with the provisions set out below, consumers may enter into distance contracts with the business and purchase the artworks offered for sale.
The artgiannis.com website and online store are hosted and operated on an e-commerce platform provided by Shopify Inc. (“Shopify”). Shopify provides the technical hosting infrastructure, the online store software, the checkout system, as well as payment and order management services used by the Seller, in accordance with Shopify’s own terms of use and privacy policies.
The content posted in sections such as “Home”, “About” and any “News” / “Blog” sections constitutes a presentation of the artist, his work and related information about the business that manages the website and the online store. This content does not constitute part of the online store, and the business reserves the right to change it at any time, without prior notice, at its absolute discretion.
Changes to the content of the aforementioned sections do not constitute a change in the legal identity of the business, nor do they give rise to any error regarding the identity of the contracting party to any distance contracts concluded through the online store, as defined below and in accordance with Greek Law 2251/1994 on Consumer Protection.
For the sake of brevity, the following terms will be used:
“Store” means the online shop selling original artworks, which is posted and operates on the present website artgiannis.com, and is accessible via the relevant links (e.g. “Portfolio”, “Shop”, “Works”, etc., as they may be configured from time to time).
“Seller” means the sole proprietorship of Ioannis Dendrinos, son of Thomas, with registered office at Lefkon Oreon 19, Halandri, Attica, Greece, VAT number 047680723, supervised by the Tax Office of KEFODE ATTIKIS, trading under the name “artgiannis.com”, which is the exclusive operator of this website and the contracting seller for every sale concluded via this website.
Users – consumers are hereby informed that the Seller is registered in the Registry of Suppliers Concluding Distance Contracts maintained in the General Commercial Registry (G.E.MI.) under registration number 152950203000.
“Buyer” means any user of the website who browses its sections, whether or not they enter into a contract with the Seller for the purchase of artworks.
“Agreement” means this document with all of its sections.
“Products” means all items offered for sale, including artworks, sculptures, wall pieces, light-sculptures, artistic constructions and all other creations by Ioannis Dendrinos, which are as a rule handmade and often created to order and/or according to the Buyer’s specifications.
These general terms and conditions of sale govern all transactions carried out through the Store and every aspect of the sale of Products offered for purchase by Buyers.
Modifications to this Agreement or purchases subject to a condition that this Agreement be modified are not permitted. The Seller is under no obligation to examine or accept any request by a Buyer to amend any part of this Agreement.
In the Store, the Seller lists the Products offered for sale under various categories (e.g. sculptures, wall art, lights, small art objects, etc.). The same Product may be listed in more than one category at the same time. Each sale is considered a retail sale.
Each Product offered for sale is presented to Buyers in a unique listing, which includes images of the artwork in one or more photographs.
The listing clearly indicates the price of the Product, the applicable VAT, any possibility for choosing specific characteristics (e.g. dimensions, finishing, base), a detailed description of the artwork and its technical specifications, the dimensions and, where the work is not a unique piece, the available quantity.
The prices displayed next to each Product do not include packaging and shipping costs. The Buyer is informed of these costs during the checkout process, depending on their chosen delivery options (address, country, shipping method, etc.).
The Seller reserves the right to modify at any time the description and the price of each Product. The mere posting of the Product and its price does not, by itself, constitute a binding offer. The purchase price of a Product becomes final when the order is completed by the Buyer. If, for any reason, the price changes after the order has been completed, the Seller will inform the Buyer in writing, and the Buyer will have the right to withdraw from the contract or to request a refund of the amount already paid.
The Seller may provide additional social interaction features (e.g. share buttons for social networks). The Seller accepts no responsibility for any malfunction of third-party services or for the content of third-party websites to which the website may link.
To purchase a Product, the Buyer may either create a user account or proceed as a guest (guest checkout). The personal data collected by the Seller are used solely for the purposes of executing the sales contract.
Adding Products to the “shopping cart” is a preparatory act and does not constitute an offer to conclude a contract. The Buyer’s offer to enter into a sales contract is made by submitting/confirming the order through the website’s checkout system.
The sales contract is concluded once an order confirmation email has been sent to the Buyer at the email address provided by them, confirming the order and the availability and/or production time of the artworks.
Upon conclusion of the contract, the Seller is obliged, in accordance with the agreement (creation, packaging and shipping times), to make the Products available for delivery to the Buyer.
Listing a Product for sale indicates that it is either immediately available or can be created and made available within a reasonable timeframe, as may be stated in the Product description.
The Buyer may choose a payment method among those available in the Store, including but not limited to:
bank transfer/deposit to the Seller’s bank account,
credit/debit card payment via an electronic payment system,
PayPal or another online payment service,
cash on delivery (COD) via courier (only if explicitly offered).
Credit/debit card payments are processed via the payment systems provided by Shopify (e.g. Shopify Payments or integrations with third-party payment providers) and/or other certified electronic payment providers, who act as a payment gateway / payment processor. The Buyer enters their card details in a secure environment controlled by Shopify and/or the respective payment provider, who uses appropriate security measures in accordance with its own terms and policies.
The Seller does not store and does not have access to the Buyer’s full card details (card number, CVV, etc.). Such details are sent to and processed directly by Shopify and/or the respective payment provider, who acts as an independent payment service provider. For any issues concerning the operation of the payment system or possible data breaches relating to card details, the Buyer must contact the payment provider and their bank directly.
If the Buyer chooses to pay via PayPal, they are redirected to PayPal’s website by a secure redirect from Shopify. The login details and completion of the payment take place exclusively on PayPal’s platform, in accordance with PayPal’s terms of use and privacy policy. The Seller does not see and does not store the Buyer’s PayPal login or bank details.
During the entire “intermediate stage” between selecting a payment method at checkout and entering/processing the banking/payment details (in the Shopify and/or PayPal environment), the technical process is governed by Shopify’s and the payment provider’s terms and conditions. The Seller is responsible only for correctly recording the order and the amount payable, and is not responsible for any technical malfunctions, delays or errors of the payment systems of third parties.
Products are shipped to the address provided by the Buyer. The Buyer is responsible for the accuracy of the shipping details. If the details are incorrect, any additional reshipping costs are borne by the Buyer.
The Seller makes every reasonable effort to ensure safe packaging and reliable shipping of the artworks. The risk of loss or damage to the Products passes to the Buyer upon delivery of the Products to the Buyer or to a third party duly authorised by the Buyer.
The Products sold through the Store are as a rule handmade artworks, unique pieces and/or made to order and according to the Buyer’s specific requirements (e.g. specific dimensions, colours, special compositions, custom orders).
Under the applicable consumer protection laws for distance contracts, the right of withdrawal does not apply where the object of the contract is:
goods made to the consumer’s specifications, or
clearly personalised goods, or
goods which, by reason of their nature, cannot be returned without substantial deterioration in their value or safety.
Consequently, the Buyer expressly acknowledges and accepts that they do not have a right of withdrawal from the sales contract for the Products purchased via the Store.
As a result, returns of Products are not accepted, except in the following specific cases:
if the Product is objectively defective upon delivery, or
if a wrong Product or quantity has been shipped compared to the order.
Products are considered defective if:
they do not have the agreed properties as described on the website,
they suffer significant damage that is not due to shipping or to the Buyer’s use,
they are not accompanied by the agreed accompanying documents (e.g. certificate of authenticity, where applicable).
Products are not considered defective in the following cases:
the Buyer simply changes their mind or aesthetic preference regarding the artwork,
natural variations and tolerances (e.g. slight differences in colour, texture, patina) which are inherent in handmade and artistic work,
damage occurring after delivery as a result of improper handling, impact, dropping, inappropriate placement or maintenance by the Buyer.
In the event of a defective Product or an incorrect shipment, the Buyer must notify the Seller promptly and within a reasonable period of time from delivery, by sending:
a description of the problem, and
photographic documentation of the artwork and its packaging,
to the email address indicated in the “Contact” section of the website.
Once the Seller has verified the defect or the incorrect shipment, the Seller may, at its discretion:
replace the artwork with a new one, if feasible, or
refund the purchase price, in whole or in part, or
repair or correct the artwork, where practically possible.
In all cases, the Seller’s liability is limited to the total value of the defective or incorrectly shipped Product, and does not extend to any further direct or indirect loss or damage suffered by the Buyer.
Where the Products are unique works accompanied by a certificate of authenticity, the Buyer is informed that they constitute original creations by the artist within the meaning of Greek Law 2121/1993 on copyright.
In the event of a subsequent resale of such a work, the Buyer must inform the new owner of the obligation to comply with the provisions on the artist’s “resale right” (droit de suite) and any obligations to notify the relevant authorities, in accordance with applicable law.
In addition to the above, the Buyer/user is obliged:
to use the website and its services in accordance with good faith and fair trading practices,
not to attempt any unlawful access to or intervention in the software, server or operation of the Store,
not to generate artificial traffic or load on the system that could render the website inoperative or degrade its performance.
The Buyer undertakes to indemnify the Seller for any loss or damage suffered by the Seller as a result of the Buyer’s wilful misconduct or gross negligence, as well as for any amount that may be paid to third parties following judicial or extrajudicial settlement due to the Buyer’s acts or omissions.
The website and its content are provided “as is”, and the Seller does not assume any obligation or liability and does not guarantee:
the accuracy, quality, completeness and validity of its content as a whole,
the content of third-party websites to which it may link,
that the website will at all times be free from viruses or other malicious software.
The Buyer/user is responsible for taking all reasonable protective measures (updated software, antivirus, etc.) when browsing the internet.
The Seller processes Buyers’ personal data solely for the execution of orders, the operation of the Store and compliance with legal accounting and tax obligations, in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the applicable Greek legislation.
The Buyer must provide true and accurate contact and shipping details. False details may render execution of the contract impossible and may give rise to a claim for damages in favour of the Seller.
Where a user account is available, the Buyer is solely responsible for keeping their login details confidential and secure.
The Seller is the data controller for the personal data entered by the Buyer through the website and/or their account. Any use or processing of these data is carried out in accordance with the principles of lawfulness, transparency and data minimisation.
Use of Shopify Inc.
The artgiannis.com online store operates on an e-commerce platform provided by Shopify Inc. Shopify processes personal data of visitors and Buyers to the extent necessary for providing the platform, hosting, checkout and payment services, as well as other functions of the online store. In this context, Shopify may act either as a processor on behalf of the Seller, or as an independent controller for certain categories of data, in accordance with its own Consumer Privacy Policy.
Cookies and tracking technologies
For the operation of the website and the Store, small text files (“cookies”) and similar technologies are used. Some of these cookies are placed and managed directly by the Seller, while others are placed by Shopify, which provides the store software and checkout. These cookies may be strictly necessary (e.g. for login, shopping cart, secure checkout) or, where permitted, analytical/statistical and functional cookies.
The Buyer/visitor may, depending on the browser they use and the cookie settings provided by the platform (e.g. cookie banner, consent options), accept, limit or reject non-essential cookies. If technically necessary cookies are disabled, some functions of the Store (e.g. completing an order) may not be fully available.
The Buyer has the rights of access, rectification, erasure, restriction of processing and objection, which may be exercised by contacting the Seller at the email address indicated in the “Contact” section of the website.
All logos, trademarks, designs, photographs, texts, descriptions, artworks and, in general, all content of the artgiannis.com website are the intellectual and/or industrial property of the Seller, unless otherwise expressly stated.
Copying, reproduction, republication, modification or any form of exploitation of artworks, photographs and texts is prohibited without the prior written consent of the Seller, other than uses permitted by law as lawful uses.
Only personal, non-commercial use is permitted for informational purposes (e.g. saving/printing a page for personal reference), without altering or removing any indications of origin.
In the event of force majeure (as defined by the Greek Civil Code and case law) that objectively prevents performance of the sales contract, each party has the right to withdraw from the contract without liability. Any amounts already paid will be refunded to the Buyer within a reasonable period of time.
The Seller may, at its sole discretion, temporarily suspend the operation of the Store and the acceptance of new orders for as long as the force majeure event persists.
This Agreement is presented to Buyers “as is”. Acceptance of the Agreement is deemed to occur through browsing the Store and submitting orders. Partial or conditional acceptance of the Agreement is not possible.
If any provision of this Agreement is found to be invalid, such invalidity shall be limited to that provision alone and shall not affect the validity of the remainder of the Agreement.
For any dispute arising out of or in connection with this Agreement, the parties will make every effort to resolve it amicably. If this is not possible, the Courts of Athens, Greece shall have exclusive jurisdiction.
This version of the terms is effective from the date of its publication on the artgiannis.com website and replaces any previous terms of use & transactions.
